By visiting our site and/or purchasing equipment or services from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

Section 1—Consumer Guarantees Act (CGA) & Fair Trading Act (FTA)
As a New Zealand-based business, nothing in these Terms of Service is intended to avoid, restrict, or modify the application of any consumer guarantees under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
- Consumers: If you are acquiring goods for personal, domestic, or household use, you have certain rights and remedies that cannot be excluded.
- Business Use: If you are acquiring goods for the purposes of a business (e.g., a commercial Pilates studio), you agree that the guarantees provided under the Consumer Guarantees Act 1993 do not apply to the transaction.
Section 2—Online store and pricing
- Pricing: All prices on the website are in New Zealand Dollars (NZD) and include GST (Goods and Services Tax) unless expressly stated otherwise.
- Shipping: Delivery costs are calculated at checkout and are additional to the product price unless specified. We reserve the right to apply surcharges for rural or remote delivery.
- Platform: Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you.
Section 3—Accuracy of billing & orders
We reserve the right to refuse any order. For high-value equipment purchases, we may require additional identity verification or payment confirmation to prevent fraudulent activity. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
Section 4—Products & warranties
- Accuracy: We make every effort to display the colors and images of our products as accurately as possible. However, we cannot guarantee your monitor's display will be 100% accurate.
- Warranties: High-ticket equipment (such as Reformers) may come with specific manufacturer warranties. Please refer to our Warranty Policy for details on frame, component, and wear-and-tear coverage. These warranties exist alongside your rights under the CGA.
Section 5—Delivery & risk
For large equipment deliveries, risk of loss or damage passes to you upon delivery to the address provided.
- Inspection: It is your responsibility to inspect large items upon arrival. Any damage caused during transit must be reported to us within 48 hours of delivery to facilitate a claim with the carrier.
Section 6—Returns & cancellations

- Faulty Goods: If a product is faulty, we will fulfill our obligations under the CGA (repair, replacement, or refund).
- Change of Mind: We are not legally required to provide a refund for a "change of mind." However, if we do agree to a return for a non-faulty high-ticket item, you will be responsible for all return shipping costs and a potential restocking fee.
Section 7—Personal information & privacy
Your submission of personal information through the store is governed by our Privacy Policy, which complies with the Privacy Act 2020. We use third-party tools (such as HubSpot and Klaviyo) to manage customer data and improve our service. By using this site, you acknowledge that your data may be processed via these platforms.
Section 8—Limitation of liability
To the maximum extent permitted by New Zealand law, FPL shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind, including lost profits or lost revenue, arising from your use of any of our products or services.
Section 9—Governing law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Zealand. Any disputes will be subject to the non-exclusive jurisdiction of the New Zealand courts.
